The agreements signed by the client offered him no protection; on the contrary, they contained provisions under which he could lose a substantial amount of money.
ESSENCE OF THE DISPUTE:
The client decided to purchase a premium-class apartment.
He contacted a real estate agency. They found a seemingly suitable option and offered to sign a Letter of Intent to enter into a sale and purchase agreement. The client agreed and transferred an advance payment to the seller and a rather significant amount to the real estate agency.
It later turned out that the documents for the apartment were not in order. As a result, the transaction could not be completed, so the client requested a refund. The seller decided to keep the money as a deposit, claiming the documents were flawless and that the client’s notary was fabricating issues. Representatives of the real estate agency pretended the matter did not concern them and denied receiving any funds — and then simply disappeared.
ACTIONS TAKEN:
Real estate attorneys at Juris Ferrum Law Firm in Odesa prepared and filed a claim with the court for the recovery of funds from both the seller and the real estate agency.
OUTCOME:
The court upheld the claim and ordered the recovery in favor of the client of the transferred funds, court fees, and attorney’s fees.
