ESSENCE OF THE CASE:
Our client imported fence components into Ukraine.
However, after inspecting the goods, an officer of the Odesa Customs decided that they were pipes, which are subject to a different product code and duty rates.
The customs broker provided all the necessary documents and, together with the lawyer, spent considerable time explaining why the customs declaration had been filled out correctly. Nevertheless, the Odesa Customs officer insisted on his position and issued a decision on the determination of the product code and a refusal card for the customs declaration.
ACTIONS TAKEN:
Our customs lawyers filed a claim with the administrative court challenging the decision on the determination of the product code and the refusal card. The aim was to prove that the client had determined the product code correctly.
RESULT:
The court upheld the claim, ordering the customs authority to reimburse the court fee and legal fees.
